Committing to the BSDQ is an adhesion to a collective contract which aims to establish healthy competition.
Commitment includes rights, obligations and privileges. It serves as the foundation for adhering to the Tendering code, which sets all conduct rules throughout the BSDQ submission process, enabling the achievement of shared fairness objectives. The commitment demonstrates consent to this Tendering Code.
Any project where the conditions of application provided for in the Code are met must be registered with the BSDQ, upon request by the contractors.
All related tender submissions must be made exclusively through the TES system.
A contractor who is not a member cannot benefit from the services offered by the BSDQ. Whether to transmit a tender or take possession, it is necessary that both stakeholders are committed to the BSDQ.
Taking advantage of the benefits and services offered by the BSDQ includes the following fees :
The Code stipulates that a security must accompany a bid when the amount exceeds or is equal to $100,000. This security can be in the form of a bid bond or a bank transfer worth 10% of the bid amount. A list of companies authorized to issue a bid bond and a letter of intent is appended to the Tendering Code.
When a security is attached to a bid, the bidder has a right to the contract if it is the lowest conforming bid. If no security is associated with the bids, the awarding contractor can grant a contract to any contractor who has submitted a conforming bid in the TES.
A committed contractor may revoke their commitment at any time. The BSDQ can also, under certain conditions, terminate a user's commitment. These actions will result in the permanent loss of all history related to the company's TES account.
