File 6 - J-7 request

If a recipient contractor has received one or no bids in one or more specialties, they can request the BSDQ to provide the names of companies that have submitted bids to other contractors. This allows the contractor to have the opportunity to obtain those bids as well.

When a bid is identified as UNIQUE, there is no need to make such a request, as the bid is the ONLY one submitted to the BSDQ for all recipients combined.

If there is any doubt about the eligibility of a request according to J-7, it is strongly recommended that the recipient contractor still submit their request in the TES. The BSDQ will determine the eligibility of the request.
The process described below must be completed before the project owner's closing date and time for the call for tenders

Chapter J – Article J-7

J-7 None or only one tender to a recipient contractor

If, for a regulated specialty, no tender has been addressed to one of the recipient contractors, or if only one tender has been addressed, the BSDQ may, at their request, after ensuring that these conditions exist and in accordance with the procedure established for the use of the TES, allow them to take possession of the tenders filed for that specialty as if those tenders had been addressed to them by the tenderers before the deadline for filing tenders to the BSDQ.

In accordance with the procedure established for the use of the TES, the BSDQ must ensure that the recipient contractor agrees to take possession of the tenders of the tenderers whose names are disclosed to them and must ensure that the selected tenderers authorize it to make their tenders available.

The recipient contractor is deemed to have taken possession of a tender within the meaning of this Code as soon as they have agreed to receive it, if this acceptance is followed in a timely manner, in accordance with the procedure established by the BSDQ for the use of the TES, by the tenderer’s authorization to make their tender available.

To benefit from this Section, the recipient contractor must have signed the commitment provided for in Section C-2 and have access to the TES. The contractor must make their request before the closing time for the filing of tenders by recipient contractors and take possession of the tenders of interested tenderers before that closing time.

The period for benefiting from this Section is extended by postponing the closing time for the filing of tenders by recipient contractors, unless the BSDQ is notified of the postponement after making the compilation of tenders available in the TES in accordance with the provisions of Chapter H of this Code.
