Complaint
When a contractor realizes that the project they are bidding on meets the conditions of application of the Code, as detailed in the previous section, it is their responsibility to ensure the project is registered with the BSDQ.
The project registration verification must be carried out using the « Project Search » option in the TES or the Project Bulletin Board tool.
Thus, if the sought project is not already registered, a request for project opening should be sent to the BSDQ via the TES or by email to [email protected] in order to submit or take possession of bids.
Unless set by the project owner or the professionals involved, the tender closing date at the BSDQ is always set 3 business days before the closing date of the call for tenders with the project owner.

If a project is postponed by the project owner, the BSDQ can only adjust its closing date if the postponement occurs before the initial BSDQ closing date and time, and if the BSDQ has been notified.
K-1 Contractor’s liability
It is the responsibility of tenderers and recipient contractors to comply with the tendering rules of this Code by opening a file if necessary, ensuring that they obtain and retain the correct information, both from the project owner and the contractors receiving the tender, and the BSDQ, ensuring that they are aware of any addenda that may be issued before the tender closing time, and transmitting information to the BSDQ, particularly notices of a postponement in the closing time for the filing of
tenders by recipient contractors to the project owner, all in order to avoid finding themselves in a situation where this Code has not been complied with.
E-1.1 Registration of a project
Any i nterested p arty m ay s ubmit a r equest to the BSDQ to open a file for a project. Once the necessary information has been obtained, the BSDQ opens the file and registers the project in question in the TES.
No tender or tender bond may be filed unless the project in question has been previously registered by the BSDQ, within the time limit and in accordance with the procedure established by the BSDQ for the use of the TES.
E-3 Closing date and time
The project owner may determine the closing date and time for the filing of tenders to the BSDQ; in such a situation, the BSDQ shall comply with the project owner’s instructions. In all other cases, the closing date and time for the filing of tenders shall be determined by the BSDQ, within the time limit it sets and in accordance with the procedure established for the use of the TES.
The closing ti me for the fi ling of tenders to the BSDQ i s s et b etween 10 a.m. and 4 p.m. on any business day.
The BSDQ enters this information in the TES in accordance with the procedure established for its use. The tenderer is responsible for eliciting from the BSDQ any information that may be required.

The BSDQ is then required to comply with the instructions received. In this case, only invited tenderers and selected recipient contractors are authorized, for a given project, to file a tender or take possession of it, according to the procedure established by the BSDQ for the use of the TES.
E-8 Postponement of date and closing time
The BSDQ may agree with the project owner to postpone the closing date and time for the filing of tenders at the BSDQ. If necessary, it itself shall set these terms and conditions based on the new date a nd time set by the project owner for the filing of tenders by the concerned recipient contractors. The BSDQ must be notified of any postponement in sufficient time to allow it to modify the information relating to the project in question, in accordance with the procedure established for the use of the TES.
In the event of a postponement, a tenderer who has filed a tender may retrieve it, in accordance with Section E-6 of this Code.
The tenderer who has retrieved their tender, as well as any other tenderer, may file a tender within the time limit determined by the new closing date and time for the filing of tenders.
A tender may not be retrieved by a tenderer and the closing time for the filing of tenders at the BSDQ may not be delayed if the postponement of the closing time for the filing of tenders by the recipient contractors occurs, or if the BSDQ is notified of it, after the tenders filed at the BSDQ have been made available.
